Owner Builder Defect Report

A Section 137B report is the prescribed defects inspection report used when an owner-builder sells within the statutory period. For domestic building work, the Building Act generally defines that period as 6 years and 6 months after the statutory completion date. The report must be obtained no more than 6 months before the owner-builder enters into the contract of sale.

What the inspection focuses on

The report concerns owner-builder construction, alteration or extension work relevant to the sale. Typical jobs involve bathrooms, kitchens, flooring, decks, pergolas, garages, sheds, extensions, roofing and altered internal walls. Section 137B requires the report to be obtained from a prescribed building practitioner. Current BPC guidance says the defects inspection report should list defective or non-compliant work and include detailed photographs.

What if there are no obvious defects?

That is entirely possible. The purpose of the inspection is to record the observed condition of the relevant work, not to manufacture defects simply because a report is required.
